Terms of Service

These Terms of Service ("Terms") govern your use of Herd — the website at herd.fyi, our mobile apps, and related features including email sync (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use Herd.

Who can use Herd

You must be at least 16 years old and able to form a binding contract to use Herd. You're responsible for the activity on your account and for keeping access to your phone number and sign-in codes secure.

Your account

You sign in with your phone number and a one-time code. Keep your account details accurate, and let us know at support@herd.fyi if you believe your account has been compromised.

Text messages (SMS)

Herd uses text messages for two things: sending your sign-in codes, and delivering event invites and related notifications — for example when a friend invites you to an event and you haven't installed the app yet. By providing your phone number and completing sign-up, you consent to receive these texts at that number.

Message frequency varies with your activity. Message and data rates may apply. Reply STOP to any text to opt out of invite messages, or HELP for help. You can also turn text notifications off any time in your Settings. Opting out of invite texts does not affect the sign-in codes needed to access your account. Carriers are not liable for delayed or undelivered messages.

Email sync & connected accounts

Email sync is optional. If you connect a mailbox — Gmail, via Google's Gmail API, or Outlook, via Microsoft Graph — you authorize Herd to access that mailbox on a read-only basis solely to detect ticket, event, and reservation confirmations and create events for you. Our handling of that data is described in our Privacy Policy. For Gmail it complies with the Google API Services User Data Policy, including its Limited Use requirements; for Outlook it follows the Microsoft APIs Terms of Use, and we apply the same limits to the data we receive. You can disconnect any mailbox at any time in Settings, or revoke access from your Google or Microsoft account. Detection is automated and best-effort — you're responsible for confirming your own plans.

Your content and what you share

You keep ownership of the content you add to Herd — your profile, events, and RSVPs. You grant us a limited license to host, display, and share that content as needed to operate the Service, including showing the events you choose to share with your accepted friends according to your privacy settings.

Only share information about other people (such as contacts or event attendees) where you have the right to do so.

Acceptable use

You agree not to:

  • Use Herd for anything unlawful, harmful, or abusive.
  • Access accounts, data, or events that aren't shared with you, or attempt to bypass our privacy and access controls.
  • Scrape, reverse-engineer, overload, or interfere with the Service or its infrastructure.
  • Impersonate others or misrepresent your affiliation with any person or organization.
  • Upload malware or attempt to breach the security of the Service.

Third-party services

Herd relies on and links to third parties — for example Google (Gmail), Microsoft (Outlook), ticketing and reservation platforms, and app stores. Your use of those services is governed by their own terms, and we're not responsible for their content or practices.

Event images

To show what an event looks like, Herd displays a cover image for events detected from your email or imported from a link. These images come from the event's own public listing — typically the preview or "share" image the ticketing platform, venue, or organizer publishes for that event. We store a copy on our own servers so pages load reliably and your device isn't sent to third-party servers to fetch them. We don't claim ownership of these images; they remain the property of their respective owners, and we display them only to represent the event.

Copyright & takedown

We respect intellectual property rights and respond to valid removal requests. If you own the rights to an image or other content shown on Herd and believe it's used without authorization, email support@herd.fyi with:

  • your contact information;
  • identification of the work and the specific event or image on Herd (a link is ideal);
  • a statement that you have a good-faith belief the use isn't authorized by the rights holder, its agent, or the law;
  • a statement, under penalty of perjury, that the information is accurate and that you're the rights holder or authorized to act on their behalf; and
  • your physical or electronic signature.

We'll promptly remove or disable access to properly-noticed content, and we may remove content and restrict accounts of repeat infringers.

Availability & changes

Herd is offered on an ongoing basis, but we may add, change, or remove features, and we can't promise the Service will always be available or error-free. We may update these Terms from time to time; if we make a material change we'll update the date above and, where appropriate, notify you in the app. Continuing to use Herd after a change means you accept the updated Terms.

Termination

You can stop using Herd and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. On termination, the sections that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will continue to apply.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Event details detected from email or entered by users may be incomplete or inaccurate; always verify times, venues, and tickets with the original source.

Limitation of liability

To the maximum extent permitted by law, Herd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, missed events, or lost opportunities arising from your use of the Service.
